rent in arrears and tenancy soon to expire

Hi

My tenant has not paid the last two months, July and August. Rent is due on the 14th of every month. I have tried to call on a number of occasions with no success and in the end had to drop by the house twice. Both times he has promised payment and failed to pay. His 12 month tenancy agreement is due to expire in two weeks, on 14th September so i cant help but think he may try to move on without paying the last two months. Which notice should i serve section 8 or 21? How much notice do i have to give if there has been non payments and the contract is due to end anyway? How do i go about getting the last two months rent back. The tenancy is not arranged through an agent. There is a deposit scheme so depending on damage or repairs needed to the property, this may cover at least some of the rent.
