Tenancy deposit

Hi, I am looking for some advice regarding a tenants deposit. When my previous tenant vacated my property,they left it in mess with a lot of work to be done to get it ready for another tenant. I informed them that the deposit would not be returned as the amount of work and expense i had would have to be used for the work needed.This was also obvious from the inventory that had been carried out.After the work was completed and ready for reletting i put in a claim to the tenancy deposit scheme for the full amount.I sent along all the relevant information they required along with receipts for any materials used.After a lot of chasing up and phone calls they informed me that without getting any response from the tenants they would be unable to release the deposit to me.Eventually after a certain amount of time had elapsed they agreed to send the deposit back to the letting agent that had been dealing with it.I then was told by the letting agent they could not release the deposit either because of legal reasons.So as it stands unless the previous tenants make contact with them and agree to release the deposit to me [which is very unlikely] i am left wondering what are my options.If i have to take them to court this will leave me out of pocket with costs etc.I thought the whole idea of the tds was to be able to resolve disputes like this,but it appears not. I would appreciate any advise you could give me on this.Thank you Des.
