To whom it may concern

I have withheld the deposit from tenants who moved out in June of 2012.
My reasons being
I have had to spend over £4000 on repairing damp and repainting after they left
I have never received proof that they paid their utility bills even after numerous requests for it. After 3 months we received payment requests from BT and Thames water, which we have forwarded to the tenants, but we are still awaiting confirmation of payment.

I have made many mistakes in the tenancy. In 2007 i rented out the property to friends of mine. I did not take a detailed inventory and then I returned to South Africa. Those friends then left and friends of theirs moved in which happened a few times over. All the while I had the deposit in my personal bank account, unaware of the need to have a secured deposit. I also allowed the last 2 tenants to stay without amending the contract. So the one tenant is on the lease but her partner is not.

I rented out my property in good faith and it was successful. I have trawled through the advice pages and it seems there is little to protect the landlords. What is the purpose of having a deposit if it cannot be withheld for damages?

I would like to know if I am able to withhold any money from the £1200 that is ue for the deposit.
