Tenants Have Seperated

I have a contract via a letting agent with two tenants. Sadly the man has walked out on his partner, who has just had a new baby. The contract has now expired, but the lady is still paying her rent via housing benefit with no problem. The man is constantly hassling me for his deposit back, which is held by a tenant deposit protection scheme. The agent has advised that the contract will still stand between them even though it has lapsed, unless the parties give notice.

The advice Ive been given is to server notice on the lady staying at the property. To be honest she is a good tenant who pays her rent on time and I dont want to put a new mother and baby on the street. Simply because the man wants the deposit back. To make matters worse they do not talk with each other.

Ive been advised not to agree to release the deposit until a new contract has been agreed.

I would appreciate any advice that anyone may be able to give and any potential exposure that I may have.
